1. Purpose

These terms govern access to and use of https://film.sylvainrougie.fr, published by Avatar and technically operated by the TribuShare platform (SYLOE GROUP, SAS).

These terms are brought to users' attention at account creation. By creating an account on this site, you confirm that you have read and accepted them.

By accessing this site, you also accept TribuShare's Master Terms of Service available at tribushare.com/legal/terms.

2. Seller Identification

The seller of digital content offered on this site is:

TribuShare (SYLOE GROUP, SAS) acts as a technical intermediary and marketplace operator facilitating the transaction. TribuShare is the merchant of record for payment processing — it is the entity that appears on your bank statement. TribuShare is not the seller of the content — the legal seller of the content remains Avatar, who is solely responsible for rights in the work and content warranties. Any claim or refund request may be directed to TribuShare, which handles it on behalf of the Creator.

3. Service Description

This site enables the purchase of streaming access to digital content.

Content is protected by digital rights management (DRM) and an invisible digital watermark is applied to each viewing session.

4. Price and Payment

• Price: Not provided (all taxes included for EU residents — VAT automatically calculated by Stripe Tax based on your country)
• Payment: processed securely by Stripe, Inc. via Stripe Connect
• Accepted methods: credit cards and other Stripe-supported methods in your territory

In accordance with Articles L221-5 and L221-11 of the French Consumer Code:

• Interoperability: content is DRM-protected and cannot be downloaded. Viewing is exclusively through the TribuShare platform.

Order process:

1. Account creation
2. Secure payment via Stripe
3. Purchase confirmation email (with "Watch now" link)
4. Consent to immediate delivery and withdrawal waiver — displayed after payment, before first Play
5. Immediate access to content

5. Right of Withdrawal and Refund Policy

EU/EEA/UK Consumers:

If you are a consumer resident in the European Union, European Economic Area, or the United Kingdom, you have a statutory 14-day right of withdrawal from your purchase, provided you have not commenced streaming. Once streaming has begun, the right of withdrawal is expressly waived — by clicking "Play", you acknowledge that the digital service has been delivered and you waive your right of withdrawal pursuant to Article 16(m) of Directive 2011/83/EU.

To exercise your right of withdrawal before streaming, contact [email protected] within 14 days of purchase with your order reference and the statement: "I withdraw from my purchase of access to the content."

Where you validly exercise your right of withdrawal, the refund will be processed within 14 days of receiving your notification, using the same payment method as the original transaction.

Non-EU Users:

Refunds may be requested within 14 days of purchase for content that has not been viewed. Once streaming has commenced, the transaction is final.

Refund Process:

TribuShare is the single point of contact for all refund requests.

1. Send your request to [email protected]
2. Upon receipt, TribuShare notifies Avatar, who has 48 hours to respond
3. If the Creator does not respond within 48 hours, TribuShare will process the refund in accordance with applicable law
4. Refunds are issued to the original payment method via Stripe
5. Processing time: 5–10 business days depending on your bank

6. Content Protection

Content on this site is protected by DRM technology. TribuShare applies an invisible digital watermark unique to each viewing session. Attempting to circumvent content protection measures is strictly prohibited and may constitute a criminal offence under applicable law.

7. Intellectual Property

All content on this site remains the exclusive property of Avatar and/or their rights holders. Nothing in these terms transfers any ownership rights. The TribuShare platform is the exclusive property of SYLOE GROUP, SAS.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the Creator's and TribuShare's aggregate liability is limited to the amount you paid for the relevant purchase. Neither the Creator nor TribuShare is liable for indirect, consequential, or punitive damages.

Nothing in this clause limits liability for death or personal injury caused by negligence, or any other liability that cannot be excluded under mandatory applicable law.

9. Governing Law and Disputes

These terms are governed by French law. EU consumers also benefit from any mandatory consumer protection provisions of the law of their country of residence.
